Terms of Use & End User License Agreement

1. Overview & Agreement to Terms

Welcome to WeeknightBite ("WeeknightBite," "we," "us," or "our"). These Terms of Use, together with any applicable End User License Agreement schedules and policies referenced herein (collectively, the "Terms"), constitute a legally binding contract between you ("User," "you," or "your") and WeeknightBite governing your access to and use of our mobile applications for iOS, iPadOS, and macOS (the "App"), our website at weeknightbiteapp.com, and all associated cloud services, algorithmic scheduling tools, recipe import pipelines, and digital content (collectively, the "Service").

By downloading the App from the Apple App Store, creating an account via Apple Sign-In or email, starting a free trial, purchasing a subscription, or accessing any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Apple App Store License Grant (Custom EULA)

If you obtained the App from the Apple App Store, Section 2 supplements the entire agreement between you and WeeknightBite. This agreement is concluded solely between you and WeeknightBite, and not with Apple Inc. ("Apple"). WeeknightBite is solely responsible for the App and the content thereof.

• Scope of License: Subject to your continuous compliance with these Terms, WeeknightBite grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and execute the App on Apple-branded products that you own or control, solely for personal, non-commercial household use, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (including Family Sharing and volume purchasing). If you sell, dispose of, or transfer your Apple-branded device to a third party, you must remove and uninstall the App from the device prior to transfer.
• Maintenance & Support: WeeknightBite is solely responsible for providing any maintenance and support services for the App as specified in these Terms or required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
• Warranty Limitations: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (or current subscription period) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Product Claims: WeeknightBite, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the App or the end-user's possession and/or use of that App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual Property Claims: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, WeeknightBite, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Third-Party Agreements Compliance: You must comply with all applicable third-party terms of agreement when using the App (for example, you must ensure your use of the App does not violate your wireless mobile network data service agreement or broadband internet provider terms).
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
• Export & Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• U.S. Government End Users: The App and related documentation are "Commercial Items" as defined in 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation" pursuant to 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Licensed to U.S. Government end users only as commercial end items with the rights granted to all other users under these Terms.

3. Paid Subscriptions, Free Trials & Billing (Apple IAP)

WeeknightBite offers both free core functionality and premium auto-renewing subscription tiers under the "WeeknightBite Savvy" plan (Monthly and Annual packages). Subscriptions are processed through Apple In-App Purchases and managed via RevenueCat and Apple StoreKit 2.

• 14-Day Free Trial: We may offer an introductory 14-day free trial for new subscribers. If you do not cancel at least 24 hours before the trial ends, your Apple ID will be charged for the selected subscription period upon trial expiration. Any unused portion of a free trial period will be forfeited if you purchase a subscription prior to trial completion.
• How to Cancel: You can manage or cancel your subscription at any time by navigating to your device's Settings > [Your Apple ID Name] > Subscriptions or directly through the App Store app. Canceling prevents future renewals; you will retain access to Savvy features until the conclusion of your current paid billing period.
• Price Changes: If WeeknightBite changes subscription pricing, Apple will notify you in advance in accordance with Apple App Store Guidelines. Continued use after the price change takes effect constitutes your agreement to the new price.
• Refunds: Because all transactions are processed directly by Apple, WeeknightBite cannot issue direct refunds. All refund requests must be submitted to Apple via reportaproblem.apple.com.

4. Food Safety, Health & Allergen Disclaimers

• Allergen & Cross-Contamination Warning: You are solely responsible for inspecting physical food packaging, verifying ingredient integrity, and confirming the absence of allergens (including the top 9 food allergens: peanuts, tree nuts, milk/dairy, eggs, wheat/gluten, soy, fish, crustacean shellfish, and sesame per the U.S. FDA Food Allergen Guidelines and EU Regulation No 1169/2011).
• Nutritional & Caloric Estimations: Calorie counts, macronutrient ratios, and portion metrics displayed in the App are automated algorithmic approximations. Actual nutritional content varies depending on specific ingredient brands, cooking techniques, oil absorption, and seasonal variations.
• Safe Cooking Temperatures: Users must follow proper food handling, hygiene, and safe internal cooking temperatures established by food safety agencies (such as the USDA FSIS Safe Cooking Charts: poultry to 165°F / 74°C; ground meats to 160°F / 71°C; steaks, chops, and fish to 145°F / 63°C). WeeknightBite disclaims any liability for foodborne illnesses or allergic reactions.

5. AI-Assisted Features & Smart Recipe Import

WeeknightBite utilizes artificial intelligence and natural language processing (including Google Gemini API models) to provide automated weekly meal schedules, timeline optimizations (Fastest vs. Dish Saver modes), and smart recipe text parsing.

• Personal Recipe Organizer & Note-Taking Utility: WeeknightBite is a tool for personal recipe collection and household organization. Smart Recipe Import functions as an interactive, user-initiated digital clipper and personal notebook (analogous to common note-taking and clipping tools such as Apple Notes, Microsoft OneNote, Google Keep, Evernote, Pocket, or Paprika) designed solely to allow individual home cooks to format, scale, and time recipes for private, non-commercial household meal planning.
• No Platform-Level Web Crawling or Mass Scraping: WeeknightBite does not deploy automated bots, web crawlers, or algorithmic scrapers to crawl, harvest, or aggregate recipes from external websites into a centralized public database. Only an individual user can manually submit a specific recipe URL to import on demand for their own private kitchen use.
• Prohibition on Automated or Bulk Scraping: Users must save recipes manually and individually on a per-recipe basis. The use of bots, spiders, scrapers, or automated scripts to bulk-import recipes or scrape third-party websites into WeeknightBite is strictly prohibited.
• Private Library by Default (Fair Use & Privacy Guarantee): All recipes saved via Smart Import are automatically marked as private and stored exclusively in the user's private Recipe Library by default. They are visible solely to that individual user and their authorized family household members, and are never indexed in a public search engine, published to a global community directory, or made discoverable by other unrelated users.
• Preservation of Source Attribution & Creator Links: WeeknightBite deeply respects culinary authors, food bloggers, and recipe creators. When a recipe is imported from a web source, the Service preserves the original canonical source URL, displays creator domain attribution badges, and provides direct links to the creator's original publication, driving traffic and attribution back to the recipe creator.
• EU AI Act Transparency (Article 50): In compliance with the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), we notify you that automated scheduling recommendations, smart timeline concurrencies, and recipe text extractions are generated with AI assistance. Catalog recipe photos may be generated with AI.
• Informational Verification: While our algorithms strive for culinary precision, AI outputs may occasionally contain inaccuracies in cooking duration, temperature, or ingredient proportion. Always use common culinary sense when following generated steps.
• Zero AI Training on Private Data: Your private family notes, meal calendar occupancy, and personal recipe library entries are never used to train public foundation models. See our Privacy Policy for our binding zero-training commitment.

6. User Content, Recipe Library & Feedback

You retain full ownership and intellectual property rights in any original recipe text, personal notes, cooking photos, and custom meal plans that you create or upload to your family Recipe Library ("User Content").

• License to WeeknightBite: By uploading or saving User Content, you grant WeeknightBite a worldwide, non-exclusive, royalty-free license to host, store, cache, format, parse, adapt, and synchronize your content solely as necessary to operate, maintain, and deliver the Service to you and your authorized family members. This license expressly includes technical adaptations such as automated unit conversions (Metric vs. Imperial), ingredient categorization, timeline concurrency calculations, and cross-device synchronization.
• Third-Party Recipe Import Representations: When you use our Smart Import or URL parsing tools to import third-party recipes into your private Library, you represent and warrant that: (i) the import is strictly for your private, non-commercial household use; and (ii) you will not publish, broadcast, or commercially redistribute third-party copyrighted text or imagery without the author's authorization. • No Pre-Screening of Shared or Imported Recipes: Recipes, ingredient lists, instructions, and nutritional estimates saved to or shared through the Service are provided for general household information only. WeeknightBite does not review, pre-screen, test in experimental kitchens, or verify user-generated or third-party imported recipes before they are posted or saved. You are solely responsible for verifying the safety, suitability, and ingredient integrity of all recipes before cooking.
• Feedback & Unsolicited Suggestions: If you provide WeeknightBite with any suggestions, enhancement requests, recommendations, bug reports, or feedback regarding the Service ("Feedback"), you hereby grant WeeknightBite an irrevocable, perpetual, non-exclusive, royalty-free, worldwide, fully transferable, and sublicensable right to use, incorporate, modify, commercialize, and exploit such Feedback in any manner without any obligation of confidentiality, attribution, or compensation to you.
• DMCA & Copyright Takedown: If you believe content hosted on our Service infringes your copyright, please submit a formal DMCA notice to our designated agent at hello@weeknightbiteapp.com containing: (i) identification of the copyrighted work; (ii) identification of the allegedly infringing material; (iii) your contact info; and (iv) a statement of good-faith belief.

7. Prohibited Conduct & Account Termination

You agree not to engage in any of the following prohibited activities:

• Reverse-engineering, decompiling, disassembling, or attempting to extract the source code or underlying algorithms of the App or Cloud Functions;
• Accessing, monitoring, or copying any part of the Service, proprietary meal scheduling logic, or recipe database in order to build, benchmark, train, or promote a competing software product or commercial culinary service;
• Using automated scrapers, bots, crawlers, or data extraction scripts against the WeeknightBite website, API endpoints, or database;
• Using automated bots, crawlers, spiders, or scripts to bulk-import, scrape, or extract recipes or data into or from the Service;
• Interfering with, overloading, or compromising the security or rate limits of our Firebase infrastructure or Google Gemini backend;
• Uploading malicious scripts, contaminated files, or harmful content;
• Circumventing paywalls, subscription entitlement checks, or StoreKit billing receipts;
• Renting, leasing, sublicensing, or commercially redistributing access to the Service.

8. Third-Party Services & Integrations

The Service integrates with and relies upon third-party cloud infrastructure, software libraries, and external platform services:

• Apple Inc.: StoreKit In-App Purchases, Apple Sign-In, and APNs (Apple Legal Terms).
• Google Firebase & Google Cloud: Cloud database, serverless backend, and analytics (Firebase Terms of Service).
• Google Gemini API: Generative AI parsing and inference (Google AI Terms).
• Cloudinary: Recipe photography CDN (Cloudinary Terms).
• Sentry.io: Error diagnostics and crash tracking (Sentry Terms).

WeeknightBite does not control and is not liable for the availability, terms, or privacy practices of external third-party services.

9. Disclaimer of Warranties, Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WEEKNIGHTBITE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE, OR THAT RECIPES WILL MEET YOUR CULINARY EXPECTATIONS.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, IN NO EVENT SHALL WEEKNIGHTBITE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, FOOD SPOILAGE, ALLERGIC REACTIONS, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL WEEKNIGHTBITE'S TOTAL AGGREGATE LIABILITY ARISING UNDER OR IN CONNECTION WITH THESE TERMS EXCEED THE GREATER OF: (A) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD); OR (B) THE TOTAL AMOUNT PAID BY YOU TO WEEKNIGHTBITE FOR PAID SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Multi-Jurisdictional Statutory Consumer Protection

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consumers. If you reside in one of these jurisdictions, certain provisions above may not apply to you:

• European Union / EEA & United Kingdom: Nothing in these Terms excludes or limits your statutory consumer withdrawal rights or statutory guarantees under Directive 2011/83/EU on Consumer Rights, the UK Consumer Rights Act 2015, or mandatory consumer protection rules in your member state of habitual residence.
• Australia: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010.
• United States: State consumer protection statutes that cannot be waived remain in full effect.

11. Governing Law, Binding Arbitration & Jury Trial Waiver

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any principles of conflicts of law.

• Informal Dispute Resolution: Before initiating any formal legal claim, you and WeeknightBite agree to attempt in good faith to resolve the dispute informally for thirty (30) days by contacting our team at hello@weeknightbiteapp.com.
• Agreement to Binding Individual Arbitration: If unresolved within thirty (30) days, all disputes, claims, or controversies arising out of or relating to these Terms, the App, or the Service shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may assert qualifying individual claims in small claims court.
• Arbitration Opt-Out: You may opt out of this arbitration agreement by sending an explicit written opt-out notice within thirty (30) days of first accepting these Terms to hello@weeknightbiteapp.com with the subject line [Arbitration Opt-Out].
• WAIVER OF JURY TRIAL: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WEEKNIGHTBITE HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL BEFORE A JUDGE OR JURY.
• CLASS ACTION WAIVER: TO THE EXTENT PERMITTED BY LAW, ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.

12. Modifications to Terms & Electronic Communications

• Modifications to Terms: WeeknightBite reserves the right to modify or update these Terms at any time in our discretion. When changes are made, we will update the "Effective Date" at the top of this page. Your continued use of the Service after the effective date of updated Terms constitutes your binding agreement to the modifications. If you object to any change, your sole remedy is to cease using the Service.
• Consent to Electronic Communications: By accessing the Service, you consent to receiving electronic notices, disclosures, and communications from WeeknightBite via email, push notification, or in-app announcements. You agree that all electronic notices satisfy any statutory legal requirement for written notice.
• Entire Agreement & Severability: These Terms, together with our Privacy Policy and Apple EULA terms, constitute the complete and exclusive agreement between you and WeeknightBite regarding the Service. If any provision is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
